1. INTRODUCTORY PROVISIONS

These Terms and Conditions (hereinafter: the "Terms") govern the relationship between 4 BY 4 (hereinafter: the "Association", "we" or "us") and users (hereinafter: "you" or the "user") of the manual.hr web portal (hereinafter: the "Portal").

The Portal is owned and operated by:

4 BY 4
Ivana Zajca 24, 51000 Rijeka, Croatia
Registration number (OIB): [insert OIB]
Executive Delegate: Mirko Trkulja

By using the Portal, you accept these Terms in full. If you do not agree with any part of these Terms, please do not use the Portal.

These Terms apply together with the Statute of the Association and the Privacy Policy, which form an integral part of this agreement.

2. DESCRIPTION OF THE SERVICE

2.1. What is manual.hr

The manual.hr Portal is a digital platform of 4 BY 4 that enables:

  • Publishing and viewing information about events organized by the Association

  • Publishing blog content related to musical culture, art and the Association's work

  • Purchasing tickets for events

  • Managing membership in the Association and paying membership fees

  • Inviting new members to the Association

2.2. Public access and member-only sections of the Portal

The Portal is not intended exclusively for members of the Association. Certain parts of the Portal are publicly accessible to all visitors, without the need for registration:

  • All blog posts

  • The list of events organized by the Association

Ticket purchasing for events is available to the public when a particular event is marked as open to the public (not restricted exclusively to Association members). If an event is intended exclusively for Association members, ticket purchasing for that event is available only to logged-in members.

The following functionalities are available exclusively to registered members:

  • Managing your personal profile and user account

  • Paying membership fees and accessing member benefits

  • Inviting new members

  • Accessing content and events marked "members only"

  • Receiving the newsletter

3. REGISTRATION AND MEMBERSHIP

3.1. Conditions for registration

To register a user account on the Portal, you must:

  • Be at least 18 years of age

  • Provide accurate, complete and up-to-date personal data

  • Accept these Terms, the Privacy Policy and the Statute of the Association

  • Have the legal capacity to enter into a binding contract

3.2. Registration and membership fee

Registering a user account on the Portal is free of charge.

Payment of the annual membership fee is voluntary. You are not required to pay a membership fee in order to keep your user account or to have basic access to the Portal. Members who voluntarily pay the annual membership fee gain additional benefits described in Article 4 of these Terms.

3.3. Registration process

Registration on the Portal takes place through an invitation from an existing regular member of the Association, in accordance with the Statute of the Association, which requires a recommendation from an existing member for joining the Association.

  • The registration link (invitation) is valid for 6 months from the time it is sent

  • After the 6-month period expires, the invitation ceases to be valid and the invited person's data is deleted from the system

  • By completing the registration form and accepting these Terms, the user account is automatically activated – no additional decision or approval by the Executive Delegate is required, nor confirmation via a verification email link

  • The rights and obligations of a member are acquired on the day registration is successfully completed

3.4. Our responsibility

We strive to ensure that the information on the Portal is accurate and up to date, but we do not guarantee complete accuracy, reliability or availability of the Portal at all times.

All personal data you enter during registration and use of the Portal is stored in encrypted form in our database, in accordance with the measures described in the Privacy Policy.

3.5. Your responsibility

You are responsible for:

  • The accuracy of the data you provide during registration

  • Maintaining the confidentiality of your access credentials

  • All activities that take place through your account

We reserve the right to suspend or terminate your user account if:

  • You provide inaccurate, outdated or false data

  • You violate these Terms, the Statute of the Association or the general acts of the Association

  • You act in a way that harms the reputation or interests of the Association

  • You misuse the functionality for inviting new members

4. MEMBERSHIP FEE AND BENEFITS

4.1. Voluntary membership fee payment

Payment of the annual membership fee is voluntary. The amount of the membership fee for each year is determined by the Assembly of the Association, in accordance with the Statute.

Registration, basic use of the Portal and status as a member of the Association do not depend on payment of the membership fee – the membership fee provides additional benefits, but non-payment does not affect your status as a registered user of the Portal.

4.2. Method of payment

The membership fee is paid via the Portal using the Stripe payment system. Accepted payment methods are shown during the payment process.

4.3. Duration

The paid membership fee is valid for 365 days from the date of payment, after which it expires, unless the Assembly of the Association decides otherwise.

4.4. Refunds

The paid membership fee is, as a rule, non-refundable. Exceptions are considered on a case-by-case basis, based on a written request submitted to the Executive Delegate.

5. EVENTS AND TICKETS

5.1. Purchasing tickets

Tickets for events are purchased via the Portal using the Stripe payment system. After a successful purchase, the ticket (e-ticket) is sent to your registered email address.

5.2. Prices and availability

Ticket prices are determined separately for each event and may vary depending on the event category, early sales, or other promotional conditions. The number of tickets per event is limited by available capacity.

5.3. Benefits for members with a paid membership fee

Members who have paid the annual membership fee receive free admission to all events organized by the Association, subject to the available capacity of the particular event.

This benefit is available only for the duration of the paid membership and does not apply to members who have not made payment for the current period.

5.4. Cancellation and ticket refunds

  • If the Association cancels an event, the full amount of the paid ticket is refunded to users

  • Refunds for tickets on the user's initiative are possible up to 7 days before the event date, subject to a handling fee if applicable

  • After this deadline expires, refunds are not possible, except in exceptional circumstances decided upon by the Executive Delegate

5.5. Program changes

The Association reserves the right to change the date, time, location or performers of an event due to circumstances beyond its control. Users will be notified in a timely manner of any significant changes.

6. CONTENT AND USER CONDUCT

6.1. Association content

Blog posts, event descriptions and other content published by the Association are owned by the Association and protected by copyright.

6.2. User-generated content

If the Portal allows users to publish content (comments, reviews, etc.), you retain ownership of your content, but you grant us the right to use that content for the purpose of operating the Portal.

You must not publish content that is unlawful, offensive, discriminatory, that infringes the rights of third parties, or that otherwise harms the Association or other users.

6.3. Removal of content

We reserve the right to remove any user content that violates these Terms, without prior notice.

7. PAYMENTS

7.2. Currency and taxes

All prices on the Portal are expressed in euros (EUR) and include all applicable taxes, unless otherwise stated.

8. INVITING NEW MEMBERS

8.1. Right to invite

Registered members may invite new people to join the Association through the invitation functionality on the Portal, in accordance with the Statute, which requires a recommendation from an existing member.

8.2. Responsibility when inviting

When inviting a new person, you are obliged to:

  • Ensure you have that person's consent to send the invitation

  • Use the invitation functionality exclusively for legitimate purposes, and not to send unsolicited messages (spam)

  • Only invite persons whom you reasonably believe meet the membership conditions (18+ years of age)

8.3. Validity of the invitation

A sent invitation is valid for 6 months. If the invited person does not complete registration within this period, the invitation and associated data are automatically deleted.

9. COMMUNICATION

9.1. Transactional messages

By registering, you agree to receive transactional emails necessary for the functioning of your account (registration confirmations, e-tickets, payment confirmations, account security notices, etc.). These messages cannot be disabled while you use the Portal.

The newsletter is sent exclusively to registered members who have given explicit consent. You may withdraw your consent at any time via the unsubscribe link in the newsletter or through your account settings.
